Continuance Granted

I was able to secure the necessary documentation from the attorneys I have been interviewing and provide that documentation to the court this morning. The Deputy District Attorney expressed his desire that I am represented by an attorney for these proceedings and did not object to the continuance. I waived my right to a speedy trial to provide everyone with the time required (another 6 months) to prepare to resolve this case.

On September 10th, 2009 I have another hearing scheduled with the court to set the case for trial. On this date I do need to have an attorney hired and representing my interests.

The Judge did state that there is flexibility in this date to meet the schedule of the attorney I do hire and that the attorney would know how to work with the court to move the date if necessary. The Judge also mentioned that if needed it might be possible to have the attorney attend this meeting remotely via tele-conference.

I am in the process of the final attorney interviews and retaining a lawyer to represent me. I would like to have that process completed within the next two week and leave plenty of time before the September 10th date.

The Deputy District Attorney stated that the plea he offered was a split plea. Unless the Deputy D.A. has changed the offer this admission proves that my prior attorney was not communicating the plea bargain accurately do me (both before and after he was fired).

The Deputy D.A. and the Judge both indicated a strong preference to have this case settled through a plea instead of proceeding to trial
