Was the Deputy Sheriff Trespassing (From the Judge’s perspective)?: Yes!
Were the two Social Service Workers Trespassing (From the Judge’s perspective)?: Yes!
Impact to the charges and case against me: None!
Government employees are obviously above the law. The law is not there to protect our natural rights but rather to encourage the Police and Social Service workers from BREAKING The Law. Does this form of deterrence work? Absolutely NOT! Why would the Sheriff of the Social Service workers care if they break the law — there is no impact to them, there is no accountability, it does not stop them from pressing malicious and expensive criminal charges against The People!!
I attempted to file trespassing charges against the Deputy and Social Service Workers through a 911 call immediately following this event. The Sgt. refused to take the complaint. I attempted to file an internal affairs complaint with the Adams County Sheriff’s department ->They just turned my complaint over to the investigating detective to build a case against me.
In essence, there is not such thing as private property, there is no such thing as an expectation of privacy, there is no control over lawless behavior by our government employees.
Notice how the Judge claims that being “charged with committing a crime” outweighs my natural rights. Never mind that holding a gun on your own property is NOT a crime, it is fundamental right in Colorado! The Judge was fully aware based on the sworn statements of the Deputy + the two Social Service Workers at the Motions Hearing that I never pointed my gun at them, that I never issued any verbal threats, I was simply standing one quarter mile deep within my own property holding my gun.
Then the Judge goes on to encourage the Social Service workers rogue behavior by concluding that as “state actors” they also have the ability to break the law without consequence.
Since “Our Supreme Court has concluded that evidence of that conduct need not be suppressed because it does not result in permitting state actors to exploit any unlawful entry…” Huh?? If these folks had not attempted an aggressive entry onto my property in order to “surprise me” (their words under oath) then I would not have been standing in my driveway with a gun prepared to protect myself, my family, my home and my property!!! Of course this allowed the “state actors” to exploit their illegal trespassing — heck, it encourages them!!
The Judge states that their actions constituted third degree criminal trespassing and yet I am the only person charged with a crime by the District Attorney. Great County, Great State, Great Country…. Obviously, the Deputy and the Social Service workers were the aggressors and I was simply defending myself and my family. Who cares? Does anyone Care?
Although the Judge carefully drafted his opinion he in fact did not suppress anything! I saw two cars headed fast my way, I grabbed my gun and stood at the end of the driveway, I told them to leave if they had no warrant (repeatedly) and they left. The clever wording of the Ruling hides the fact that not one piece of information has been suppressed.
I wonder if the Judge will be shocked to learn that during their ransacking our home and property during their search they took my drivers license, my gun case, my gun lock (but no guns) and some mail… and apparently they took quite a few pictures of our home and belongings. They found no evidence of anything illegal. Yet, the Judge issues his Ruling and creates the impression that not all of the pertinent evidence was presented at the motions hearing and that “additional evidence was obtained after a search warrant was issued and executed”. This is the Judge that signed that search warrant!
Clearly, I have been frustrated these last few days as I have attempted to vent into this web site and reclaim a calm mind. This is exactly the Judicial behavior that I have been blogging about: Complete disregard for the U.S. and Colorado Constitutions. As Charlie Brown used to say: ARGHHH!!
I reckon I am just too stupid to know I am a SLAVE.
